Travel Giveaway - Official Terms & Conditions

Promotion Period: May 11, 2026 - June 30, 2026  |  Draw Date: July 1, 2026

1. PROMOTER

This promotion ("Giveaway") is administered solely by Spotminders LLC. The Giveaway is in no way sponsored, endorsed, administered by, or associated with Apple Inc. or any other third party.

2. ELIGIBILITY

The Giveaway is open to individuals worldwide who satisfy all of the following conditions:

• Are at least eighteen (18) years of age at the time of entry;
• Are not employees, officers, directors, agents, or contractors of Spotminders LLC or members of their immediate families or households;
• Are not residents of Florida or New York; residents of those states are not eligible to enter;
• Are not residents of jurisdictions where such promotions are prohibited or restricted by applicable law. Entrants are solely responsible for determining whether their local laws permit participation;
• Have complied with all applicable requirements of these Terms.

Spotminders reserves the right to verify eligibility at any time and to disqualify any entrant who does not satisfy these requirements. 

Residents of jurisdictions requiring prior registration or bonding of this promotion are not eligible.

3. PROMOTION PERIOD

The Giveaway commences at 12:00 AM Eastern Time on May 11, 2026 and closes at 11:59 PM Eastern Time on June 30, 2026 ("Promotion Period"). Purchases made outside the Promotion Period are not eligible. Spotminders' server timestamp shall be the definitive record of purchase time.

4. HOW TO ENTER - NO PURCHASE NECESSARY

There are two ways to enter:

Method A - Purchase Entry

Complete a purchase of one (1) or more eligible products on spotminders.com during the Promotion Period. Each eligible product in a qualifying order constitutes one (1) entry, up to a maximum of ten (10) entries per order, regardless of the number of products purchased. Entry is automatic upon purchase completion.

Method B - Free Mail-In Entry (AMOE)

No purchase is required to enter. To receive one (1) free entry, send an email to support@spotminders.com with the subject line "AMOE Request - Travel Giveaway" during the Promotion Period. Include your full name and date of birth in the body of the email. Limit one (1) AMOE entry per person, per email address, regardless of the number of requests submitted. AMOE entries have an equal chance of winning as purchase-based entries.

Important: A purchase does not increase your odds of winning relative to a free entry. Odds depend on the total number of eligible entries received during the Promotion Period and cannot be determined in advance.

5. ELIGIBLE PRODUCTS & ENTRY LIMITS

All products available for purchase on spotminders.com during the Promotion Period are eligible unless expressly excluded. Entry allocation per order:

• 1 product = 1 entry
• 3 products = 3 entries
• 5 products = 5 entries
• Maximum of 10 entries per order, regardless of quantity purchased

Effect of Cancellations and Refunds. Any order that is cancelled, refunded, charged back, disputed, or identified as fraudulent — regardless of when this occurs — will result in immediate and permanent forfeiture of all associated entries. If the selected winner's qualifying order is subsequently cancelled, refunded, or charged back at any time, the Prize will be forfeited in full, the winner will be required to return any disbursed Prize funds, and Spotminders reserves the right to pursue legal recovery. Participation through fraudulent transactions constitutes a violation of these Terms and may be reported to relevant authorities.

6. PRIZE

6.1  Prize Description

One (1) Grand Prize winner will receive a cash equivalent prize of USD $10,000 (ten thousand United States dollars) ("Prize"). The Prize is awarded as a cash equivalent transfer and may be used by the winner at their sole discretion for travel or any other purpose. Spotminders does not book, arrange, or guarantee any travel on behalf of the winner. The destination and dates of any trip are entirely the winner's choice.

6.2  Prize Conditions

• The Prize has no cash alternative other than as stated herein.
• The Prize is non-transferable and may not be assigned to a third party.
• The Prize must be claimed within fourteen (14) calendar days of notification (see Section 7).
• The Prize will be disbursed via a payment method determined by Spotminders (e.g., bank transfer, PayPal, or equivalent) within thirty (30) days of winner verification and execution of all required documentation.
• All taxes, duties, and charges applicable to the receipt or use of the Prize are the sole responsibility of the winner. Spotminders will not gross up or supplement the Prize for tax purposes.
• Tax & Payment Documentation. Prior to Prize disbursement, the winner must provide all required documentation including: valid government-issued photo ID, proof of age, proof of eligible entry, completed tax forms (IRS Form W-9 for US residents; IRS Form W-8BEN for non-US residents where applicable), and valid payment details. Spotminders reserves the right to withhold disbursement until all documentation is received and verified to its satisfaction. Failure to provide documentation within thirty (30) days of Prize notification will result in forfeiture.
• The Prize may not be substituted except at Spotminders' sole discretion due to circumstances beyond its reasonable control.

7. DRAW & WINNER NOTIFICATION

The draw will take place on or around July 1, 2026. The winner will be selected by a random draw conducted using a random selection method applied to all eligible entries received during the Promotion Period. The draw process will be documented and records retained for a minimum of one (1) year following the draw date. The winner will be notified by email to the address associated with their qualifying entry within five (5) business days of the draw.

Odds. Odds of winning depend on the total number of eligible entries received during the Promotion Period and cannot be determined in advance.

Response Deadline. The winner must respond to the notification email within fourteen (14) calendar days of the date the notification is sent. Failure to respond within this period will result in forfeiture of the Prize. Spotminders reserves the right to select an alternative winner from the remaining eligible entries using the same draw process. This process may be repeated up to three (3) times, after which the Prize may be withdrawn at Spotminders' discretion.

Verification. The winner may be required to provide proof of identity, age, and eligible entry before the Prize is disbursed. Failure to provide satisfactory verification within a reasonable period will result in forfeiture.

8. PUBLICITY

By accepting the Prize, the winner grants Spotminders a royalty-free, perpetual, worldwide license to use their name, likeness, and general location (city/country) for promotional and marketing purposes in any media, without further compensation, unless prohibited by applicable law. The winner may opt out of publicity use by notifying Spotminders in writing; opting out will not affect their entitlement to the Prize.

9. LIMITATION OF LIABILITY

9.1  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPOTMINDERS, ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AND AFFILIATES (COLLECTIVELY, "SPOTMINDERS PARTIES") SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THIS GIVEAWAY, INCLUDING BUT NOT LIMITED TO: (A) LATE, LOST, INCOMPLETE, OR MISDIRECTED ENTRIES; (B) ANY TECHNICAL FAILURES, ERRORS, OR MALFUNCTIONS; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF ENTRIES; (D) ANY INJURY, LOSS, OR DAMAGE OF ANY KIND ARISING FROM OR IN CONNECTION WITH PARTICIPATION IN THIS GIVEAWAY OR THE ACCEPTANCE, USE, OR MISUSE OF THE PRIZE.

9.2  The Spotminders Parties make no representations or warranties regarding any travel services, accommodations, or experiences the winner may elect to purchase with the Prize funds. All such arrangements are solely between the winner and their chosen third-party service providers.

9.3  Spotminders' total aggregate liability to any entrant arising under or in connection with this Giveaway shall not exceed the value of the Prize (USD $10,000).

10. INDEMNIFICATION

Each entrant agrees to indemnify, defend, and hold harmless the Spotminders Parties from and against any and all claims, demands, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) the entrant's participation in the Giveaway; (b) any breach of these Terms by the entrant; (c) any misrepresentation made by the entrant; or (d) the winner's use of the Prize.

11. DISQUALIFICATION & FRAUD

Spotminders reserves the right to disqualify any entrant who: (a) tampers with or attempts to tamper with the entry process; (b) acts in a fraudulent or unsportsmanlike manner; (c) provides false information; (d) violates these Terms; or (e) uses automated systems, bots, scripts, or other means to generate entries beyond what is permitted. Fraudulent activity may be referred to relevant authorities and may result in legal action.

12. MODIFICATION & CANCELLATION

Spotminders reserves the right, in its sole discretion, to modify, suspend, or terminate the Giveaway at any time without prior notice if the Giveaway has been compromised by fraud, technical failure, or any other cause beyond Spotminders' reasonable control that affects the administration, security, fairness, or integrity of the Giveaway. Participants will be notified via the Spotminders website.

13. PRIVACY & DATA PROTECTION

Personal information collected in connection with this Giveaway will be processed in accordance with Spotminders' Privacy Policy, available at spotminders.com/policies/privacy-policy. By participating, entrants consent to the collection, use, and processing of their personal data for the purposes of administering the Giveaway, verifying eligibility, disbursing the Prize, and complying with applicable legal obligations.

14. GOVERNING LAW & DISPUTE RESOLUTION

14.1  Governing Law. These Terms and any dispute arising out of or in connection with this Giveaway shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles.

14.2  Dispute Resolution. Any dispute, claim, or controversy arising out of or relating to these Terms or the Giveaway shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in Dover, Delaware. The arbitrator's award shall be final and binding.

14.3  Class Action Waiver. TO THE EXTENT PERMITTED BY LAW, ENTRANTS WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING AGAINST SPOTMINDERS.

14.4  Jurisdiction. For any matters not subject to arbitration, entrants consent to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

15. GENERAL PROVISIONS

• Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• Waiver. Failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
• Entire Agreement. These Terms constitute the entire agreement between Spotminders and each entrant with respect to the Giveaway.
• Language. In the event of any conflict between a translated version and the English version, the English version shall prevail.
• No Affiliation. This Giveaway is not affiliated with, sponsored, endorsed, or administered by Apple Inc., Meta Platforms, TikTok, Instagram, or any other third-party platform.
